Terms of Use & Privacy Policy

("NEO Company", "we", "us", "our") is a finance company offering Shariah-compliant financing products through this mobile application (the "App").
By downloading, registering on, or using the App, you agree to be bound by these Terms of Use and this Privacy Policy (together, the "Terms"). If you do not agree, please do not use the App.
PART A — TERMS OF USE
1. Eligibility
To use the App and apply for our services, you must:
- Be at least 18 years of age (Hijri or Gregorian, as applicable).
- Be a Saudi national or a legal resident of the Kingdom of Saudi Arabia holding a valid National ID or Iqama.
- Successfully complete identity verification through the National Single Sign-On service (Nafath).
- Have full legal capacity to enter into binding contracts under the laws of the Kingdom.
We reserve the right to decline registration or any financing application at our sole discretion, in accordance with applicable laws and our internal credit and compliance policies.
2. Account Registration and Security
2.1 You must provide accurate, current, and complete information during registration and keep it updated at all times.
2.2 Your identity will be verified through Nafath and other government-approved verification channels. You consent to such verification.
2.3 You are responsible for maintaining the confidentiality of your login credentials, PIN, and any biometric authentication enabled on your device. All activities carried out through your account are deemed to be performed by you.
2.4 You must notify us immediately through the App or our customer care channels if you suspect any unauthorized access to your account or loss of your registered device.
2.5 One account is permitted per customer. You may not register on behalf of another person or allow another person to use your account.
3. Our Services
3.1 NEO Company provides Shariah-compliant consumer financing products, including Tawarruq-based financing, in accordance with the rulings of our Shariah Committee.
3.2 All financing is subject to credit assessment, eligibility criteria, and approval. Submission of an application does not guarantee approval.
3.3 The specific terms of any financing — including the financing amount, term cost, Annual Percentage Rate (APR), installment schedule, fees, and early settlement terms — will be set out in the financing contract and disclosure documents presented to you before you sign. In the event of any conflict between these Terms and a signed financing contract, the financing contract prevails for that transaction.
3.4 By proceeding with a financing application, you appoint NEO Company (or its designated agent) to execute the commodity purchase and sale transactions required to complete the Tawarruq structure, as detailed in the financing contract.
4. Credit Bureau Consent
By applying for financing, you expressly authorize NEO Company to:
- Obtain your credit record from the Saudi Credit Bureau (SIMAH) and any other licensed credit information company;
- Disclose information about your financing, payment behavior, and defaults to SIMAH and other licensed credit bureaus, in accordance with the Credit Information Law and its Implementing Regulations;
- Verify your income and employment information through approved channels, including government and semi-government data sources.
5. Electronic Transactions and Signatures
5.1 You agree that applications, contracts, disclosures, and notices may be executed and delivered electronically through the App, and that your electronic acceptance (including via Nafath authentication, OTP, or in-app confirmation) constitutes a valid and binding signature under the Electronic Transactions Law of the Kingdom of Saudi Arabia.
5.2 Records of your electronic acceptance maintained in our systems constitute conclusive evidence of your consent, absent manifest error.
6. Payments and Obligations
6.1 You must pay all installments in full and on time in accordance with your financing contract, through the payment channels made available in the App (including SADAD and linked payment methods).
6.2 Late or missed payments may result in: reporting to SIMAH, which may affect your credit record; charitable late-payment amounts as permitted under Shariah and disclosed in your contract; and legal action to recover outstanding amounts.
6.3 You may request early settlement at any time. Early settlement terms, including any waiver of future term cost, are governed by your financing contract and applicable SAMA regulations.
7. Prohibited Use
You must not:
- Use the App for any unlawful purpose, including money laundering, terrorism financing, or fraud;
- Provide false, misleading, or incomplete information;
- Attempt to interfere with, reverse engineer, decompile, or compromise the security of the App;
- Use automated tools, bots, or scrapers to access the App;
- Use the App on a jailbroken or rooted device (we may restrict access from such devices for security reasons).
We may suspend or terminate your access, and report to competent authorities, if we suspect any violation of this section or of applicable law, including the Anti-Money Laundering Law and Counter-Terrorism Financing Law.
8. Account Suspension, Deactivation and Termination
8.1 You may request deactivation of your account through the App or customer care, subject to full settlement of all outstanding obligations.
8.2 We may suspend or restrict your account where required by law or regulation, where we detect suspected fraud or unauthorized access, or where you breach these Terms.
8.3 Termination of your account does not release you from any outstanding financial obligations under an active financing contract.
9. Intellectual Property
The App and all content within it — including software, design, text, logos, and trademarks — are the property of NEO Company or its licensors. You are granted a limited, personal, non-exclusive, non-transferable license to use the App for its intended purpose. No other rights are granted.
10. Availability and Disclaimers
10.1 We strive to keep the App available at all times but do not guarantee uninterrupted or error-free operation. The App may be unavailable during maintenance or due to circumstances beyond our reasonable control.
10.2 Any calculators, estimates, or indicative figures shown in the App are for guidance only and are not binding offers. Binding terms are those stated in your signed financing contract and official disclosures.
11. Limitation of Liability
To the maximum extent permitted by applicable law, NEO Company shall not be liable for indirect, incidental, or consequential losses arising from your use of the App, including losses caused by device compromise, third-party network failures, or your failure to safeguard your credentials. Nothing in these Terms excludes liability that cannot be excluded under the laws of the Kingdom of Saudi Arabia or SAMA regulations, including our obligations under SAMA's consumer protection principles.
12. Complaints
If you have a complaint, please contact us first through the in-app support channel, or via our customer care number or email listed in Section 20. We will acknowledge and handle your complaint in accordance with SAMA's complaint-handling requirements. If you are not satisfied with the outcome, you may escalate your complaint to the Saudi Central Bank through SAMA Cares.
13. Governing Law and Jurisdiction
These Terms and any financing contracts are governed by the laws and regulations of the Kingdom of Saudi Arabia. Any dispute that is not resolved amicably shall be referred to the Committee for Banking and Finance Disputes and Violations or other competent judicial authority in the Kingdom.
14. Amendments
We may update these Terms from time to time to reflect changes in law, regulation, or our services. Material changes will be notified to you through the App or your registered contact details. Your continued use of the App after the effective date of any change constitutes acceptance of the updated Terms.
PART B — PRIVACY POLICY
NEO Company is committed to protecting your personal data in accordance with the Personal Data Protection Law (PDPL) of the Kingdom of Saudi Arabia, its Implementing Regulations, and applicable SAMA rules on data management and cybersecurity.
15. Data We Collect
We collect the following categories of personal data:
- a. Identity and contact data: name, National ID / Iqama number, date of birth, nationality, address, mobile number, and email, including data retrieved through Nafath and other government verification services with your consent.
- b. Financial data: income, employment details, bank account details (including IBAN verification), credit record and score from SIMAH, existing obligations, and transaction history with us.
- c. Device and technical data: device model, operating system, unique device identifiers, IP address, app version, and mobile network information.
- d. Usage data: in-app activity, session logs, and interactions with our services and support channels.
- e. Biometric and security data: where you enable fingerprint or face authentication, biometric verification is performed on your device; we receive only confirmation of successful authentication. We also collect behavioral and device signals used for fraud detection and prevention.
- f. Location data: approximate location, where permitted by your device settings, used for security, fraud prevention, and regulatory compliance purposes.
- g. Communications: records of calls, messages, and correspondence with our customer care, retained for quality and compliance purposes.
16. How We Use Your Data
We process your personal data for the following purposes and legal bases:
- Providing our services: assessing your applications, executing financing contracts, managing your account, and processing payments (performance of a contract);
- Identity verification and fraud prevention: verifying your identity through Nafath, monitoring transactions and device signals to detect and prevent fraud, unauthorized access, and financial crime (legal obligation and legitimate interest);
- Credit assessment: obtaining and sharing credit information with SIMAH and other licensed credit bureaus (legal obligation and your consent);
- Regulatory compliance: meeting our obligations under SAMA regulations, the Anti-Money Laundering Law, tax laws, and other applicable legislation, including regulatory reporting (legal obligation);
- Service improvement: analyzing usage to improve the App's performance, security, and user experience (legitimate interest);
- Communications: sending you service notifications, payment reminders, and — only with your consent, which you may withdraw at any time — marketing communications (consent).
We do not sell your personal data.
17. Sharing Your Data
We may share your personal data with:
- Regulators and authorities: the Saudi Central Bank (SAMA) and other competent government or judicial authorities, where required by law;
- Credit bureaus: SIMAH and other licensed credit information companies;
- Government verification services: Nafath and other approved national platforms, for identity and data verification;
- Service providers: carefully selected providers who support our operations (such as cloud hosting, payment processing, fraud monitoring, customer support, and collections), under contracts that require them to protect your data and process it only on our instructions;
- Professional advisors: auditors, legal counsel, and consultants, under confidentiality obligations;
- Corporate transactions: a successor entity in the event of a merger, acquisition, or restructuring, subject to applicable law.
Your personal data is stored and processed within the Kingdom of Saudi Arabia. Any transfer of personal data outside the Kingdom will only take place in compliance with the PDPL and applicable SAMA requirements.
18. Data Security and Retention
18.1 We apply administrative, technical, and physical safeguards consistent with SAMA's Cyber Security Framework and industry standards, including encryption of data in transit and at rest, access controls, and continuous security monitoring.
18.2 We retain your personal data for as long as necessary to fulfill the purposes described in this Policy and to comply with legal and regulatory retention obligations (generally at least ten years following the end of the customer relationship, as required for financial records under applicable regulations). Data no longer required is securely deleted or anonymized.
19. Your Rights
Subject to the PDPL and applicable regulations, you have the right to:
- Access the personal data we hold about you and request a copy;
- Correct inaccurate or incomplete data;
- Request deletion of your data, where it is no longer required for the purposes, it was collected for and we are not legally obliged to retain it;
- Withdraw consent to processing based on consent (such as marketing), without affecting the lawfulness of prior processing;
- Be informed about how your data is collected and used.
To exercise any of these rights, contact us through the channels in Section 20. We will respond within the timeframes required under the PDPL. If you believe your data protection rights have been violated, you may lodge a complaint with the Saudi Data & Artificial Intelligence Authority (SDAIA) as the competent authority.

21. Language
These Terms are issued in Arabic and English. In the event of any inconsistency between the two versions, the Arabic version shall prevail.
